1. Agreement

These Terms of Use apply to the PowerNapTime website and provide product-specific safety and usage information for the PowerNapTime app. By using the website or app, you agree to these terms. If you do not agree, do not use the website or app.

2. App license and ownership

Apps downloaded through Apple’s App Store are licensed, not sold. Your license to PowerNapTime is governed by Apple’s Standard Licensed Application End User License Agreement ↗ and the applicable App Store usage rules. If these terms conflict with the Standard EULA regarding your app license, the Standard EULA controls.

PowerNapTime, its original artwork, interface, documentation, and website content are owned by Timothy Nice and protected by applicable intellectual-property laws. You may use the app only on Apple-branded products you own or control as Apple’s rules permit. You may not copy, redistribute, reverse engineer, or create derivative works except where applicable law expressly permits it.

3. General wellness only

PowerNapTime is a general wellness and time-management utility. It is not a medical device, does not diagnose, treat, cure, or prevent any condition, and does not provide medical advice. Smart Wake is a conservative estimate of a favorable wake opportunity, not clinical sleep-stage detection.

Do not use PowerNapTime as a substitute for professional medical advice, diagnosis, treatment, or medically required monitoring. Seek qualified care for sleep concerns or symptoms.

4. Alarm limitations and safe use

The hard deadline is the app’s latest planned wake time, not a guarantee that an alarm will sound. Ordinary notifications can be affected by device volume, Silent Mode, Focus, notification permissions, power state, operating-system behavior, hardware failure, app deletion, and other conditions outside the app’s control.

Before relying on PowerNapTimeUse Test Alarm and check your device settings.

Do not rely on PowerNapTime where a missed alarm could create a risk of injury, health harm, missed medication, unsafe driving, missed transport, employment consequences, or other significant loss. Never operate a vehicle or equipment while drowsy.

5. Apple Health, sensors, and external services

Apple Health, notification, microphone, motion, heart-rate, and Watch features are optional and depend on compatible hardware, permissions, operating-system behavior, and Apple services. Features may be unavailable, delayed, or changed. You are responsible for deciding which permissions to grant and for maintaining compatible devices and settings.

Links to Apple, GitHub, and other external services are provided for convenience. Their services and content are governed by their own terms and privacy practices.

6. Acceptable use

You may not misuse the app or website, interfere with their operation, attempt unauthorized access, use them unlawfully, or infringe another person’s rights. Support channels must not be used to publish health records, secrets, unlawful material, harassment, spam, or malicious code.

7. Availability, warranty, and liability

To the maximum extent permitted by law, PowerNapTime and this website are provided “as is” and “as available,” without guarantees of uninterrupted availability, accuracy, fitness for a particular purpose, or a particular wake result. Nothing in these terms excludes rights or warranties that cannot legally be excluded.

To the maximum extent permitted by law, Timothy Nice is not liable for indirect, incidental, special, consequential, or punitive loss arising from use of or inability to use the app or website. Any additional warranty, maintenance, product-claim, and third-party-beneficiary terms applicable to the app are provided by Apple’s Standard EULA.

8. Changes and termination

The app, website, and these terms may change over time. Material changes will be posted here with a new effective date. You may stop using the app at any time. Rights under the app license may end if you fail to comply with applicable terms.
